Secret suit aims at ICC evidence

President Kenyatta is suing Safaricom in the High Court in camera

In perhaps the strongest signal that President Uhuru Kenyatta’s defence team is now preparing for a full-blown trial at The Hague in November, his lead International Criminal Court counsel, Stephen Kay QC, last week began actions in the High Court in Nairobi. News emerged on 30 July that in the previous week Kay had made an application to the court concerning Safaricom Ltd. and Airtel Ltd, but the subject of the action was kept secret and the media was removed from the courtroom. The substance of the suit remains confidential but the nature of the application and the circumstances in which it was granted are raising eyebrows.
