President Kibaki is undermining efforts to reform the judiciary as he protects his allies from prosecution

The latest dispute between President Mwai Kibaki and Prime Minister Raila Odinga began in late January, when Odinga accused Kibaki of failing to consult him about nominations to the soon-to-be-vacated positions of Chief Justice, Attorney General (AG) and Director of Public Prosecutions (DPP). Behind this local row is the threat of prosecution at the International Criminal Court of six top politicians and officials for political killings (AC Vol 52 No 1). The ICC list includes two of Kibaki’s inner circle: Finance Minister Uhuru Kenyatta, son of founding President Jomo Kenyatta, and the head of the civil service, Francis Muthaura. Another two are former allies of Odinga’s – William Ruto and Henry Kosgey (both of whom face separate corruption cases).
