Kinshasa in court

President Joseph Kabila's government now has the distinction of facing three international court cases in which foreign companies accuse it of arbitrarily seizing their assets. The biggest plaintiff is Vancouver-based First Quantum Minerals, which launched its case at the International Court of Arbitration in Paris this year. FQM is disputing Kinshasa's expropriation of the US$750 million Kolwezi tailings project, in which the company claims it had invested more than $400 mn. After persuading Canada to raise the issue in June at the G-20 in Ottawa (AC Vol 51 No 13), FQM seems to have given up all hope of restitution of its copper sites in Kolwezi and is stepping up its media and legal campaign against Kinshasa and Eurasian Natural Resources Corporation (ENRC), which has been awarded the concession.
