Short walk to freedom

Lawyers and legal experts are still seeking answers as to why, for the first time in Malawi – and possibly for every legal system based on English common law worldwide – a convicted prisoner has been released on bail. The prisoner in question is former Justice Minister and Attorney General Ralph Kasambara, who is serving a 13-year prison sentence for conspiracy to commit murder. Supreme Court of Appeal Judge Dunstain Mwaungulu put the judicial world in a spin when he released Kasambara from prison on 14 March citing only 'the interests of justice', pending the hearing of his appeal against conviction and sentence.
